Partners
Being in a serious relationship with a British or settled partner does not guarantee that a visa will be granted to enter the UK. The immigration rules set out certain “hoops” to jump through, the most controversial one probably being the need to show financial support in ways which are strictly defined.
We can advise Applicants and their Sponsors on the detail of the immigration rules and the procedures to use when applying for a visa. We can check draft applications and supporting documents and can write her own letter to support an application, perhaps elaborating on the detail and explaining any inconsistencies.
Once a visa has been granted she can advise Applicants on the next steps needed to ensure that they will be able to extend their leave when the time comes and on any pitfalls to watch out for in the future.
Children
The child of a British or settled parent is not guaranteed a visa to join that parent in the UK. Usually a child can only join both parents or a parent with “sole responsibility” and it is vital that Applicants and their parents understand what this means and what information and documents to use.
We can advise Applicants and their parents on the detail of the immigration rules and on the likely success or otherwise of an application. We will advise on the procedures to use when making an application and can check draft applications and supporting documents before they are submitted. Often a supporting cover letter from JHI, emphasising important points and explaining any complexities will be useful.
Once a visa has been granted we can advise a child and the parent/s on the next steps needed to ensure that they will be able to extend their leave when the time comes and on any pitfalls to watch out for in the future.
Parents
Having a British or settled child in the UK does not guarantee that a parent can come to the UK to live here. We can advise parents on the requirements of the immigration rules which include a parent needing to have an active role in a child’s upbringing as well as the ability to support and house themselves without public funds. We can check draft applications and supporting documents as well as preparing a letter of support for an application.
Other Dependent Relatives
It is very difficult to obtain a visa as the dependent relative of a British national or someone with settlement. We can advise on the likely chances of success before an application is made and on the consequences of an application being made and refused. We can help Applicants and their Sponsors by checking draft applications and supporting documents and can write a letter of support to deal with any points needing elaboration or clarification.
